The passing of a partner, parent or loved one, is distressing and an emotionally charged time for all involved. Stress and emotions can be raised further when a will is challenged and claims are made by others for a share in the estate or by existing beneficiaries to increase their share, which they already stand to inherit.
Property and money can also be left to individuals in a trust which takes such trust property or funds outside the scope of the deceased’s estate. Again, such trusts can give rise to dispute after the death of the settlor.
