Background
In August 2023, 10-year-old Sara Sharif was murdered by her father and stepmother. Her tragic death gained widespread media attention.
From birth, Sara was placed under a Child Protection Plan and was the subject of three family court cases in 2014, 2019, and 2021. The decisions made by three judges in these proceedings resulted in Sara spending time in foster care, her mother’s care, and ultimately, her father’s care.
High Court Decision
An application was made to the High Court by journalists and media organisations to report on Sara’s historic court cases as a matter of public interest. The case was heard on 9 December 2024 by Mr Justice Williams, who ruled that access could be granted to certain historic case papers. However, names, ages, and protected characteristics of Sara’s siblings remained confidential. Additionally, reporting on third parties, including social workers, guardians, and judges, was prohibited.
Court of Appeal Decision
On 24 January 2025, the Court of Appeal overturned Mr Justice Williams’ decision, ruling that the judges involved in the historic cases should be named. The judges were given seven days’ notice before their names were released.
On 31 January 2025, the judges were named as HHJ Raeside, HHJ Nathan, and HHJ Williams.
This decision represents a significant step forward in increasing transparency in family court proceedings.
